In 2019, while the highway was being built in Maharajganj town of Uttar Pradesh, the homes of 123 individuals were demolished. After listening to the petition from Manoj of Hamidnagar, the court has made a landmark ruling. This has led to the hope of assisting other victims. The astonishing fact is that the road for which 123 homes were cleared by bulldozers remains unfinished. The construction from Saxena Chowk to the Hanumangarhi junction remains unfinished.
Victims Dhyanchand, Deepak Sharan Srivastava, and Shail Jaiswal stated that the court has safeguarded the interests of all parties involved. In this instance, the petitioner Manoj had brought a case concerning the tearing down of his house. He had notified the court regarding the incident and provided evidence.
The Supreme Court stated that the compensation order and departmental action must be implemented within one month. In addition to departmental measures, it is essential to file a criminal case against individuals who engage in such unlawful activities.
In addition to the petitioner Manoj Tibrewal, the state government must look into the homes of other individuals that have been razed there. It must be determined if the legal procedures were adhered to in those instances or not.
Manoj Tibrewal, who lives in Hamid Nagar, Maharajganj, stated that he had submitted a letter to the Supreme Court in 2019, detailing the incident that occurred to him. He stated that on September 13, his family home was torn down amid the building of the National Highway. Prior to this, the land had not been obtained, nor had they received any notice about encroachment. Out of nowhere, the house was torn down. The chance to take out the possessions stored in the house was also not offered.
