SC warns NCPCR not to involve them in dispute with missionaries

Criticizing the National Commission for Protection of Child Rights (NCPCR), a panel of Justices B V Nagarathna and Nongmeikapam Kotiswar Singh rejected the petition submitted by the child rights organization. It was mentioned that the relief requested is broad and unclear, and therefore cannot be taken into account.

In the beginning, the attorney representing the NCPCR stated that the plea requested a time-bound investigation of all similar organizations in Jharkhand under the supervision of the apex court to safeguard children.

The Supreme court stated that the NCPCR has the authority to investigate and respond in accordance with the law under the Commission for Protection of Child Rights (CPCR) Act, 2005.

In 2020, the NCPCR requested the enforcement of the rights to prevent human trafficking as guaranteed by Article 23 of the Constitution.

Discrepancies in children’s homes across different states were identified and included as parties in the plea.

The petition mentioned instances of child rights abuse in Jharkhand and stated that the officials in the state have taken an indifferent stance in safeguarding children.

“NCPCR petitioner’s investigation unveiled shocking details of children being sold in children homes according to victims.” The plea stated that despite the state government (Jharkhand) being informed about these facts, there were ongoing efforts to obstruct and hinder the investigation.
